Privacy Policy

1. Data Controller

3. Purpose of Processing
Your data is processed exclusively to: (a) respond to your inquiry and provide a tailored proposal, (b) execute the agreed-upon web design services, (c) communicate project updates and deliverables, and (d) comply with legal obligations under Spanish and EU law.

4. Legal Basis
Processing is based on your explicit consent (Art. 6(1)(a) GDPR) when you submit the contact form, and on contractual necessity (Art. 6(1)(b) GDPR) when a service agreement is established.

5. Data Retention
Inquiry data is retained for 12 months from the date of submission. If a service agreement is established, project-related data is retained for the duration of the contract plus 6 years as required by Spanish commercial record-keeping obligations.

6. Third-Party Sharing
We do not sell, rent, or trade your personal information. Data may be shared with: Stripe (payment processing), Google Maps (location services), and hosting providers strictly necessary for service delivery. All third-party processors operate under EU-approved data protection agreements.

7. Your Rights
Under GDPR, you have the right to: access your data (Art. 15), rectify inaccurate data (Art. 16), request erasure (Art. 17), restrict processing (Art. 18), data portability (Art. 20), and object to processing (Art. 21). To exercise these rights, contact us at [email protected].

8. International Transfers
Your data is processed within the European Economic Area. If any data transfer occurs outside the EEA, we ensure adequate safeguards through Standard Contractual Clauses (SCCs) or adequacy decisions.

Terms of Service

1. Agreement to Terms
By engaging WebPatternWorks for web design services, you agree to these Terms of Service. These terms govern the relationship between WebPatternWorks (P.º de la Farola, 8, Málaga-Este, 29016 Málaga, Spain) and the client.

2. Scope of Services
Services include web design, UI/UX design, landing page creation, e-commerce storefronts, brand identity systems, and related digital interface services as outlined in the agreed proposal or statement of work.

3. Project Process
Projects follow a structured phases: Discovery & Briefing, Wireframing & Concept, Design & Development, Review & Revisions, and Final Delivery. Each phase requires client approval before proceeding to the next.

4. Pricing & Payment
All prices are quoted in Euros (EUR). A 40% deposit is required before work commences. The remaining 60% is due upon final delivery and before the transfer of source files. Late payments incur a 2% monthly surcharge after a 7-day grace period.

5. Revisions
Standard packages include up to 3 rounds of revisions per project phase. Additional revisions beyond this allowance are billed at €75/hour. Revision scope changes that fundamentally alter the project brief may require a separate quote.

6. Intellectual Property
Upon full payment, all final deliverables including design files, source code, and assets transfer to the client. WebPatternWorks retains the right to display completed work in portfolios and case studies unless a non-disclosure agreement is in place.

7. Cancellation
Cancellations made before work commences receive a full deposit refund. Cancellations during active phases forfeit the deposit and are billed for work completed to date. Either party may terminate with 14 days written notice.

8. Liability
WebPatternWorks' total liability shall not exceed the total project fee paid. We are not liable for indirect, consequential, or incidental damages. Client is responsible for providing accurate content and timely feedback.

9. Governing Law
These terms are governed by Spanish law. Disputes shall be resolved through the courts of Malaga, Spain, unless both parties agree to alternative dispute resolution.

10. Amendments
WebPatternWorks reserves the right to update these terms. Clients will be notified of material changes via email. Continued engagement after notification constitutes acceptance.

Cookie Policy

1. What Are Cookies
Cookies are small text files stored on your device when you visit our website. They help us ensure the site functions correctly and remember your preferences.

2. Essential Cookies

Refund Policy

1. Deposit Refund
The initial 40% deposit is fully refundable if cancelled before any design work has commenced. Once the Discovery & Briefing phase has begun, the deposit becomes non-refundable.

2. Milestone-Based Refunds
For projects paid in installments, refunds are calculated based on the percentage of completed work at the time of cancellation. Completed milestones are non-refundable.

3. Non-Refundable Items
The following are non-refundable: completed design phases, third-party software licenses purchased on behalf of the client, stock assets or fonts procured for the project, and domain registration fees.

4. Disputed Deliverables
If deliverables do not match the agreed scope in the statement of work, WebPatternWorks will revise the work at no additional cost within 14 days of delivery. Disputes must be raised in writing within 7 days of delivery.

5. Refund Process
Refund requests should be submitted to [email protected] with the project reference and reason for the request. Approved refunds are processed within 14 business days via the original payment method.

6. Currency
All refunds are issued in Euros (EUR). Exchange rate differences between the original payment date and refund date are borne by the client.
